600 milion yen trial of Kazuko Hosoki


　Mizoguchi Atsushi wrote “A resume of a witch Kazuko Hosoki” for “weekly Gendai” which was a serial article in forteen installments from May to August,2006.
The forth installment of it was “Hosoki Kazuko asked gang exective to kill off my article”( June 10, 2006 issue )
　Mizoguchi wrote on that issue as follows.

　<Of course I and an editorial department asked for an interview to Hosoki on 21,April, before a serialization starts. But on 24, April, as for Hosoki side, a staff of Hosoki office replied “coverage refusal” on the phone. And at the same day, Abe Kou lawyer who call himself a legal adviser of Hosoki replied “she refuse the interview. I want you to understand that we give no comment” also on the phone to the editorial department.
　It was the stage that an article had not yet made. But Abe lawyer already contained us by saying “ If there will be a part of defamations, then we will react again.” This was an exceptional react.
It is not a matter even If Hosoki does not take an interview. Direct coverage of Hosoki is not prerequisite condition to write an article of her. On the contrary, to meet her may bring a danger of making bond. Since Mizoguchi had been believed that even Hosoki refused taking interview in the beginning, she would come to take it by going through installments, so that he was going easy and continued interview on her participants.

　On 24th, the day when they replied “coverage refusal”, Mizoguchi interviewed a former senior exective of a wide area gang. On their parting, Mizoguchi asked him to introduce someone who know Hosoki’s days of Sibuya hyakkenten.
Then, on 25th, the following day, the former senior exective called Mizoguchi.

“I called Hosoki after had interviewed by you. She said on the phone, though it was a fact that a house of Hosoki did a thing such as a geisha house, She didn’t sell herself. By the way, don’t you think it worth nothing to write about Hosoki now?”
“ I don’t think so. And it is not the story that can be just talked on the telephone.”
　The writer answered.
If you say you would write it by all means, can you write it in the way of protecting Hosoki ? It will be better for each other.
The former senior exective said.
　The situation had developed far from being introduced someone who is familiar with Shibuya at the time.
After this call, the writer met another senior exective of wide erea gang who is still in comission. The day before, he called the writer and said “ Can you meet me. I will come anywhere at your convenient.” But the writer replied “No, I will come to your place.” And that afternoon, he visited senior exective’s office.
Though the writer hadn’t asked an interview for him, He knew that Mizoguchi would write on Hosoki. Mizoguchi is acquainted with him from before, and he is one of the important interview source. Though it may cause misunderstanding to write like this, but Mizoguchi trusts his personality.
The senior exective took him to a coffee shop and started to say “Can’t you stop writing on Hosoki. If you say you stoped, It is all done.”
Mizoguchi had half expected his attitude like that.
“No, This is the project of editorial department. So, even I back down, they would just look for another writer. I can’t back down.”
“Well, You will not back down.” The senior exective was considering for a while.
Then, young man who had waited in the rear said “ Phone call from Mrs. Hosoki” and gave his cellular phone to the senior exective.
“ Yes, He seems not dropping. Yes. Yes.”
Senior exective had been talked for few minutes to person who supposedly Hosoki. Probably, Hosoki asked the senior exective for stoppage engineering of the serial. And called him to check wether things went well or not.
After finishing the phone call, senior exective incidentally restarted the conversation.
“ If you say you don’t drop, It can’t be helped. But she is not a bad woman and says good things on TV. So, I want you to write on her as softly as possible.”
When Mizoguchi nodded and was going to stand up, Senior exective tried to put an envelope which sealed tight in his pocket of a suit. He refused it and said “ I can’t accept it.” When he push back the envelope to exective's hands, by the feel, He found it is bankrroll in the envelope. He guesses it wasn’t a small amount.
Exective said.
“ Even I give it to you, I do not intend to say meanness thing as don’t write. It is just for you to take Hosoki gently. This is between you and me. If we keep it secret, nobody would know.”
“ It does not go so. I can’t excuse to the editorial department.”
“ You don’t need to say to the editorial department, do you.”
“ It is not a matter of if the others don’t know the fact, I receive money or not. It is a matter of conscience that how you were at the time. Like your boss.”
Probably, the last line worked. The head of his group is known for strictness with himself. And senior advisor respect him deeply.

　Approximately for 10 minutes, He and Mizoguchi repeated the giving and the refusing, but finally, he said "you are a hardheaded" and gave up the giving.
The writer declare that he thanks to him to abandoned “bribe”
　The writer thanks him to gave up "bribery" and declares that he has no hostility or no harm intent aginst him. Therefore, I concealed group name and his real name here. But for Hosoki who asked former/ present senior exectives of wide erea gang to stop a serialization, He has a different feeling. The person who comment on the radio wave media asked gang and was trying to stop an article which she expect to be disadvantage for her at her discretion.
　The writer kneenly realized by such immediate experience that Hosoki’s relationship to gang is not just a half way. She associate with surprisingly large number of bosses or exectives of gang, and try to command them just by calling them. It is natural that people knows this circumstances more or less would have a scare and fear towards Hosoki.

　What Kazuko Hosoki went mad in, She says "There is no such a fact. It’s a defamation. It’s a defame of honor." to Mizoguchi’s article of telling the pressure from gang. And she started a civil suit of asking for 600 million yen against Koudansya publisher without to sue Mizoguchi who is a author of this article.　Perhaps Hosoki considered with her "kindness” if she accuse Mizoguchi, in a court they would study the existance of pressure by gang. Then Mizoguchi would apper in court and would testify one after another for existance of pressure. The pressure was being against Mizoguchi. It is easy for Hosoki to figure out that if Mizogucchi would testify, his testimony would have reality, because Mizoguchi actually experienced it.　
Therefore, Mizoguchi is an unlucky person for Hosoki. She does not want to accuse him as much as possible. But if she ignore the articl as “Hosoki Kazuko asked gang exective to kill off my article”, her program would be discontinued and she would be driven out from a TV station.
　A commercial broadcasting broadcast by using public radio wave. If the fact that broadcast T.V. performer have relationship with gang, or she worked for ban article by asking gang would clealy proved, even impudence ignorance Tvstation cannot keep the performer.
　For not be kicked out from TV station, she was plunged in making any action. As a result of it, the makeshift that she found with driven into a corner was a last resort which she accuse only Koudannsya publisher. If she accse, she can excuse for TV station and smooth over entertainment magazines for a moment.

　It is a libel trial for making form to deny the fact that politicians use often. The fact is just what pointed out by Medea, but cannot squash the public opinion unless deny it. If a trial began and when society forgot, withdraws it in secret, They think it is easy not to be examined. Hosoki relied on money, and must have gone for the same action.
　But It is different for Mizoguchi. By any chance if Koudansya lose a suit to Hosoki, his credit as a writer will fall down. Above that he has responsibility that he wrote the article in question. Even he has been not accused by Hosoki, He is not in a position to take trial of Hosoki vs Koudasnsya as no concern of him.
Therefore Mizoguchi decided to participate the trial as a “supporter defendant”. Even a person who is not be accused by Hosoki can participate the trial as a supporter defendant, When the result of the trial would seriously affect on his concern.

　In September, 2006, Mizoguchi did commission a lawyer and proposed of supporting defendant to 16 parts of Tokyo district court civil affairs.
　Then Hosoki side strayed here again and what a surprise but argued back as “ we don’t accept Mizoguchi’s participation as a supporting defendant.”
The reason is that Mizoguchi will participate the trial for reporting. If they let Mizoguchi participate, he will write substances of the trial
　A trial is not a secret. Besides Mizoguchi is the person concerned with the trial.
There is no reason why it is bad to write about the trial in court as far as It worth reading for readers. Or Hosoki side has a sheme of string-pulling to the defense in court in law?
　The 32nd article of the constitution says “ Nobody is deprived the right to participate a trial in court.” A right to take a trial is one of the basics right of the nation, and say of Hosoki side is impossible from a beginning.
　Of course Mizoguchi wrote a statement book and argued against Hosoki side, and a lawyer of an agent wrote "an argument for formal objection" (for supporting participaticipation) and submitted it to a court of law. Tokyo district court accepted supporting participation of Mizoguchi in December, 06, and substantial trial began at the same month.

　Hosoki will confront the fact that how she relate with gang, how she asked gang exectives for putting pressure on serialization in "the weekly Gendai" despite the road which she chosen by herself in this way.
